Terms of Service
Effective date: July 6, 2026. Muse is operated by Viision Studios, Inc. ("Muse," "we," "us," or "our"). These Terms of Service govern your access to and use of usemuse.app, any related Muse mobile experience, and any products or services we make available through them.
Muse is currently pre-launch. The website is informational and does not currently offer live checkout. We may update these terms before paid services become available.
What Muse Is
Muse is a digital retail experience for discovering, collecting, and purchasing physical designer handbags and related accessories. Items offered through Muse are physical goods shipped to eligible delivery addresses, unless a product page says otherwise.
Muse is a retail service for physical merchandise. Purchases on Muse, when available, are for physical products or access to purchase physical products, and do not pay out cash or cash-equivalent rewards.
Eligibility
You must be at least 18 years old and able to form a binding contract to use Muse. If you use Muse on behalf of an organization, you represent that you have authority to bind that organization to these terms.
Geographic Availability and Compliance
Muse may not be available in every jurisdiction. You are responsible for complying with the laws that apply to you, including consumer protection, import, export, sanctions, and tax laws. We may restrict, suspend, or refuse access to Muse or a transaction if we believe doing so is necessary for legal, compliance, risk, or security reasons.
Accounts
Some features may require an account. You agree to provide accurate information, keep your login credentials secure, and notify us if you believe your account has been compromised. You are responsible for activity under your account unless the activity was caused by our error.
Communications
By providing an email address, phone number, or other contact method, you agree that we may contact you about your account, orders, products, support requests, policy updates, security issues, and other service-related matters. Marketing messages, where offered, will be sent only as permitted by law and may be stopped using the instructions in the message.
Product Information
We try to describe products accurately, including condition, materials, measurements, colors, and included accessories. Product images, colors, and condition details may vary based on lighting, screen settings, and the pre-owned or vintage nature of certain items.
Unless expressly stated, Muse is not affiliated with, endorsed by, or sponsored by the brands whose products may be offered through Muse. Brand names are used only to identify authentic products.
Authentication, Condition, and Availability
When applicable, Muse may use internal review, third-party experts, supplier representations, documentation, and other commercially reasonable methods to evaluate products. Authentication and condition review can involve judgment, and no review process can guarantee that every issue will be identified.
Product availability is not guaranteed until an order is accepted. Products may be unique, limited in quantity, pre-owned, vintage, sourced from third parties, or subject to availability checks before shipment.
Orders, Payments, and Taxes
When checkout becomes available, placing an order will be an offer to purchase the applicable product. We may accept, decline, cancel, or limit an order for reasons including product unavailability, suspected fraud, pricing or listing errors, payment issues, or compliance concerns.
Prices, taxes, shipping charges, and any other fees will be shown at checkout where applicable. Payments may be processed by third-party payment providers. We do not store full payment card numbers on our servers.
You authorize Muse and its payment processors to charge the payment method you provide for approved purchases and related amounts shown at checkout. You represent that you are authorized to use the payment method. You agree not to initiate an improper chargeback or payment reversal and to contact us first so we can attempt to resolve order issues.
Fraud Review and Purchase Limits
We may use manual and automated review to prevent fraud, abuse, payment risk, policy violations, or unauthorized activity. We may delay shipment, request additional information, limit quantities, cancel orders, suspend accounts, or refuse service when we determine it is appropriate.
Title and Risk of Loss
Unless otherwise stated at checkout, title and risk of loss for physical products pass to you when the product is delivered to the carrier or recipient, subject to any non-waivable rights under applicable law. You are responsible for providing a secure delivery address.
Shipping, Returns, and Cancellations
Shipping, delivery, cancellation, and return rules are described in our Shipping & Returns Policy. That policy is part of these terms. Certain items may be marked final sale or otherwise ineligible for return where permitted by law.
Acceptable Use
You agree not to:
- Use Muse for unlawful, fraudulent, or abusive purposes.
- Interfere with or disrupt the security or operation of Muse.
- Use bots, scrapers, or automated tools without our consent.
- Reverse engineer, copy, sell, or exploit any part of Muse.
- Submit false, misleading, infringing, or harmful content.
- Attempt to bypass purchase limits, fraud checks, or access controls.
- Use Muse to violate sanctions, export controls, or anti-fraud laws.
- Misrepresent your identity, payment authorization, or delivery information.
User Content and Feedback
If you submit reviews, messages, photos, feedback, ideas, or other content to Muse, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt, and use that content to operate, improve, market, and protect Muse. You represent that you have the rights needed to submit the content and that it does not violate law or anyone else's rights.
Feedback and suggestions may be used without restriction or compensation to you.
Intellectual Property
Muse, including its website, app, designs, software, text, graphics, logos, and other materials, is owned by Viision Studios, Inc. or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use Muse for your personal, non-commercial use in accordance with these terms.
Third-Party Services
Muse may rely on third-party services for hosting, analytics, payment processing, identity or fraud checks, shipping, communications, and support. Those services may have their own terms and privacy notices. We are not responsible for third-party services we do not control.
Suspension and Termination
We may suspend or terminate your access to Muse, cancel pending transactions, remove content, or close an account if we believe you violated these terms, created risk or possible legal exposure, or used Muse in a way that could harm us, other users, partners, or service providers. You may stop using Muse at any time.
Disclaimers
Muse is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers, so some of these terms may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, Viision Studios, Inc. and its officers, directors, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption arising from your use of Muse.
To the fullest extent permitted by law, our total liability for any claim relating to Muse will not exceed the greater of the amount you paid to Muse for the transaction giving rise to the claim or $100.
Indemnity
You agree to indemnify and hold harmless Viision Studios, Inc. from claims, liabilities, damages, losses, and expenses arising from your misuse of Muse, violation of these terms, violation of law, or infringement of another person's rights.
Changes to Muse or These Terms
We may modify or discontinue Muse, or update these terms, at any time. If changes are material, we will take reasonable steps to notify users, such as updating the effective date or posting a notice. Continued use of Muse after changes become effective means you accept the updated terms.
Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Courts located in Delaware will have exclusive jurisdiction for disputes that are not subject to another dispute resolution process required by applicable law.
Dispute Resolution
Before filing a formal claim, you agree to contact us at hello@usemuse.app and attempt to resolve the issue informally. If we cannot resolve the issue within 30 days, either party may pursue available remedies.
To the fullest extent permitted by law, disputes will be resolved only on an individual basis. You and Muse waive the right to participate in a class, consolidated, collective, or representative action. Nothing in this section prevents either party from seeking relief in small claims court or from seeking injunctive relief for misuse of intellectual property, security systems, or confidential information.
Severability and Assignment
If any part of these terms is found unenforceable, the remaining terms will remain in effect. You may not assign these terms without our consent. We may assign these terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
